The second person arrested in connection with a home invasion that resulted in a shooting fatality will remain in custody ahead of his trial, and prosecutors intend to try a teen allegedly involved in the crime as an adult.
The Peoria County State’s Attorney’s Office announced Monday that its request for pretrial detention for Reginald Flemister-Tolson, 23, was granted. Flemister-Tolson was taken into custody Wednesday on charges of home invasion, armed robbery and aggravated battery with a firearm.
A day earlier, Peoria police arrested a 17-year-old on similar charges for the Nov. 23 incident at Lexington Hills Apartments on the the city's west side that led to the death of Matthew Day, 17.
Prosecutors claim Day and the other teen participated in the home invasion together, along with Flemister-Tolson. They have filed a transfer motion to have the teen suspect’s case moved to adult court.
Police responded to the scene around 11:30 p.m. on the night of the crime. Day was found unresponsive with multiple gunshot wounds, and a 21-year-old man was located in a nearby apartment with bullet wounds to his legs.
According to the state’s attorney’s office, the victim told investigators there was a knock at his door and multiple attackers came in and began firing their guns.
Flemister-Tolson reportedly told detectives he went to the victim’s apartment with the two teens, knowing that Day planned to steal a gun from the resident.
