The independent candidate for Congress in Illinois' 13th district has appealed to the U. S. Supreme Court in an effort to finally get his name back on the ballot.
Bloomington physician David Gill was denied a spot earlier this week by an appeals court after previously winning a temporary stay with a judge's ruling. He's hopeful Justice Elena Kagan, who's responsible for matters in Illinois, will reverse the decision of the State Board of Elections.
Gill's campaign manager Don Necessary said he hopes county clerks will wait on mailing out ballots without Gill's name.
"I would hope that they'd hold off until Justice Kagan has a chance, today or next week, if she could make a decision favorable to us," said Necessary.
However, McLean County Clerk Kathy Michael said her office is obligated by law to have military ballots in the mail today. She said those are being sent, and polling place ballots are being printed, without Gill's name. Michael said she'll leave a write in spot open, though Gill saids he has no intention of being a write-in candidate.
"We're in this to win, and I have no plans to conduct a write-in campaign," he said.
