Aaron Rossi exits the federal courthouse in Peoria following a previous court appearance.

Former Reditus Laboratories CEO Aaron Rossi is challenging his pretrial detention by appealing to the 7th Circuit U.S. Court of Appeals in Chicago.

Chief Judge Sara Darrow on Sept. 5 ordered Rossi to remain in custody after prosecutors alleged he sold off nearly $5 million worth of assets without the court's permission, as the conditions of his release required.

Darrow also noted that the terms of Rossi's release had already been restricted after failing a drug test and admitting it could be proved he used meth.

The federal case in questions involves mail and tax fraud charges alleged to predate Rossi's tenure at Reditus. Separate federal cases are connected to Reditus, however.

Rossi didn't provide a reason for requesting an interlocutory appeal in documents filed in federal court on Tuesday, but his attorney had previously argued confinement in prison would make it difficult for him to run his other businesses.

No court date is set for the appellate court to take up the appeal, but such motions are generally heard quickly pre-sentencing.
